By participating, you accept the following conditions.

Participation

All natural persons over the age of 18 and with permanent residence in Switzerland are eligible to participate. Each person may only participate once. Employees of BLS Ltd. and its subsidiaries are excluded from participating. The information to be provided must be complete and truthful. Any automatically generated entries and/or technical manipulations will be excluded from the competition. BLS Ltd. reserves the right to exclude participants in the event of improper participation (including the provision of false data) and in such cases to award the prizes to other participants.

Participation in the competition is free of charge and free of any obligation to make a purchase or place an order in return for payment. The competition will run until the published date. 

Photography competitions

By submitting or uploading photos, participants confirm that they own all rights to the submitted photo and that they do not violate any copyrights or personal rights. This means, in particular, that participants must have the consent of the person shown for publication of the photo. If any minors are shown, participants are required to obtain the consent of the persons holding parental authority. Should third parties assert claims for violation of their rights, the participants shall indemnify BLS Ltd. against any and all claims. 

Participants retain all rights to their photos at all times. They grant BLS Ltd. the right, free of charge, to present them as often as it wishes and without any spatial restrictions, to make them publicly accessible, to distribute them and to make them available for retrieval by third parties. 

Entries that are racist, pornographic or otherwise offensive in nature or violate the competition rules are excluded. BLS Ltd. will make the final decision on approval of the photos.

Determination and notification of the winners and delivery of the prize 

The winners will be drawn at random in camera at the headquarters of BLS Ltd. in Bern. Winners will be notified personally. If a winner cannot be contacted within a reasonable period of time, BLS Ltd. shall be entitled to pick another winner. If delivery of the prize cannot take place following notification of the winner, for reasons for which the winner is responsible, the prize will be forfeited without compensation. If the prize cannot be delivered for a reason for which BLS Ltd. is not responsible, BLS Ltd. shall be entitled to provide a different prize of equal value. Delivery of the prize within Switzerland is free of charge. If claiming a prize results in subsequent costs, such costs shall be borne by the winner. The winner shall be responsible for any taxation in relation to the prize. Cash payment for the prize or provision of a different prize at the request of the winner is not possible. Prizes cannot be transferred or sold. 

Liability and legal recourse

BLS Ltd. excludes any liability in connection with the competition to the extent permitted by law, and shall not be liable for any damage inflicted by third parties. Furthermore, no correspondence will be entered into and the judge's decision is final. 

Right to cancel or modify the campaign

Any changes will be announced on the website of BLS Ltd. BLS Ltd. reserves the right to cancel or prematurely terminate the competition at any time without giving rise to claims for compensation, without prior notice and without giving reasons. This in particular for technical or legal reasons that jeopardise the correct execution of the competition.

For competitions on Meta Platforms, Inc. (Meta) 

The competition is organised by BLS Ltd. The competition is not associated with Meta and is not sponsored, endorsed or organised by Meta. BLS Ltd. is the only contact partner and has sole responsibility for the competition. 

Data privacy

BLS Ltd. points out that personal data of the participants (in particular contact details such as e-mail addresses, names, telephone numbers, photos) will only be used within the scope of the competition. BLS Ltd. treats personal data confidentially and does not pass it on to third parties. 
If the participants agree, BLS Ltd. will use the personal data to send information and offers to the participants. Participants are entitled to prohibit any further use of their personal data by BLS Ltd. at any time. 
Personal data will then be deleted as soon as it is no longer required for the aforementioned purposes or until expiry of the retention periods or statute of limitations issued by the legislator or the supervisory authorities.
